Stephen Miller Faces Off as Judges Strike Down Trump's Tariffs in MAGA Movement Turmoil

Deputy White House Chief of Staff Stephen Miller was one of several prominent individuals who criticized a federal trade court for blocking Trump’s “Liberation Day” tariffs.

"The judiciary takeover is spiraling out of control," Miller wrote On X following the decision from the U.S. Court of International Trade which stated that the International Emergency Economic Powers Act of 1977—the legislation invoked by Trump to legitimize his tariffs—does not grant him "unrestricted power."

The global and reciprocal tariff directives go beyond the powers conferred upon the president under the IEEPA for regulating imports through tariffs," the three-judge panel concluded. "The contested tariff orders will be annulled, and their implementation will be permanently prohibited.

The harshness of the decision was compounded by the involvement of a judge appointed by Trump himself: Judge Timothy Reif. He was nominated for the federal trade court position by President Trump in 2018. Joining him were Judge Jane Restani, who had been appointed by Reagan, and Judge Gary Katzmann, nominated by Obama.
